Gold Star Driving School - Learner Terms and Conditions

The learner purchasing driving lessons (referred to as "Learner"). The driving instructor providing the services (referred to as "Driving Instructor"). By booking a driving lesson/s or driving test package with Gold Star Driving School, the Learner accepts these terms.

1. License

The Learner confirms they possess a valid learner driving permit or any other legal driver's license permitting them to drive in the respective state or territory.

These terms terminate automatically if the Learner no longer holds a valid learner driving permit.

2. Relationship of the Parties

The Learner acknowledges:

• They are directly engaging a Driving Instructor who operates as an independent contractor.

• Gold Star Driving School is a platform facilitating bookings and payments; any agreement for driving lessons is solely between the Learner and the independent Driving Instructor.

 

3. Services

Gold Star Driving School agrees to provide driving lessons in accordance with these terms and applicable laws. The Learner agrees to:

• Attend lessons punctually.

• Follow all instructions provided by the Driving Instructor.

• Ensure safety during lessons by refraining from using mobile phones or other electronic devices.

 

4. Purchasing Driving Lessons

Learners may purchase driving lessons on the Gold Star Driving School website. By purchasing, Learners agree to the listed price (Fees).

Fees are charged at the time of purchase. Gold Star Driving School acts as the payment agent for the Driving Instructor.

Credits for driving lessons are non-refundable and must be used within 36 months of purchase.

 

5. Bookings and Rescheduling

Learners can schedule lessons through the website. Cancellations or rescheduling more than 24 hours in advance will result in a credit for the Learner. Cancellations within 24 hours or 'no shows' will result in the Learner being charged the full fee.

If the Driving Instructor cancels, the Learner will receive a credit.

 

6. Australian Consumer Law

Rights under the Australian Consumer Law are preserved. Learners are entitled to cancel in case of major failures and may be entitled to compensation for losses.

 

7. Limitations

Rights under the Australian Consumer Law are not affected. Liability is limited to the fees paid by the Learner. Gold Star Driving School is not liable for certain events beyond their control.

 

8. General

• Disputes should be resolved between the parties in good faith.

• These terms constitute the entire agreement between the parties.

• Gold Star Driving School may vary these terms at their discretion.

• These terms are governed by the laws of the respective state or territory.
